Alabama Supreme Court Makes Groundbreaking Decision, Determining Personhood in IVF Case

After families whose embryos were dropped by a patient at an IVF clinic sued the clinic for wrongful death of a minor, the Alabama Supreme Court determined that frozen embryos, used for IVF implantations, legally count as children. Denise Burke, senior counsel with Alliance Defending Freedom, says that the ruling is a “tremendous victory for life” and that “unborn children created through assisted reproductive technology are children under Alabama law and therefore protected. No matter the circumstances, all human life is valuable from the moment of conception.” This is a huge legal step in acknowledging where life begins.

Arkansas Gov. Sarah Huckabee Sanders signed an executive order to create a committee to formulate “comprehensive statewide strategic health plan.” particularly involving maternal health. This plan seeks to connect more women with healthcare providers before, during and after pregnancy, better advertise care and coverage options to pregnant women, improve data collection of maternal health in Arkansas, and enroll all eligible citizens in healthcare programs that cover pregnancy and postpartum care. Although the state has about 35,000 births per year, about 1,100 do not see a doctor until they are giving birth, and only 10,000 after the first trimester is over. Sanders states that this is an “education problem, not a coverage problem.”
